Military Discharge Upgrade Guide

An Other Than Honorable (OTH), General Under Honorable Conditions, or Bad Conduct Discharge (BCD) does not have to be permanent. Thousands of veterans have successfully upgraded their discharge characterization through formal legal processes — restoring access to VA benefits, federal employment preference, and in some cases, military honors. This guide explains the process.

Important

Discharge upgrade success rates have improved significantly since a 2016 DoD policy memo directing boards to give "liberal consideration" to applications from veterans with mental health diagnoses (including PTSD), MST, and TBI. If your discharge was related to any of these conditions, your chances of upgrade are substantially higher than they were before 2016.

Which Board to Apply To

Discharge Review Board (DRB)

Reviews discharges within 15 years of separation. Can upgrade OTH and General discharges. Cannot upgrade BCD or Dishonorable (those require BCMR). No cost to apply. Application: DD Form 293. Processing time: 12-24 months.

Board for Correction of Military Records (BCMR)

Can review any discharge at any time (no 15-year limit). Can change discharge characterization, reason for separation, and reenlistment codes. Also handles BCD cases. Application: DD Form 149. Processing time: 18-36 months.

Military service recordsRequest your complete service records through the National Archives (archives.gov/veterans). Your personnel file, medical records, and separation documents are the foundation of your case.

Medical documentation (if applicable)VA treatment records, private therapist records, or a mental health nexus letter from a qualified provider linking your diagnosis to your misconduct and military service significantly strengthen PTSD/TBI/MST claims.

Personal statementA detailed, honest personal statement explaining the circumstances of your discharge, your mental state at the time, subsequent rehabilitation, and the impact of the discharge on your life. This is often the most important document.

Character lettersLetters from supervisors, community leaders, clergy, employers, or others who can speak to your character before, during, and after your service. Quality matters more than quantity.

Legal representation (strongly recommended)While you can apply without an attorney, legal representation significantly improves success rates. Free legal assistance is available through National Veterans Legal Services Program (nvlsp.org), Swords to Plowshares, and many state-based veterans legal clinics.
